With no authorization?
Can a collection agency for a defaulted student loan who intercepted my tax money access my bank account?
They would have to have your acct number to get into your acct in the first place. They may be able to legally garnish money, but to do a debit they need your info. Generally they can't unless they have permission in writing. If you see anything odd, you can have your bank do an "Unauthorized ACH" investigation....there's a form you sign stating they didn't have permission to take it and they contact the company for their written authorization...

The only way they could legally get your money is if a Judge awarded them permission to put legal holds on any available funds in your bank accounts.


Also, garnished wages could result in Payments being taken directly out of your paycheck.
Reply:If they can get a court order they can get to any assets you have.
Reply:well, if you mean "with no authorization" from you, they dont always need your approval.





if they went through the courts and were granted permission by the courts, then they did have authorization, just not from you.





but some collection agencies are underhanded and you should look into if they actually got the correct authorization.
